Pilgrimage Tours – Terms & Conditions

(A Section of IPV Surakshaa Kawach Charitable Trust)

Effective Date: 1 July 2026

By obtaining Membership, registering on the official website, making any payment, booking any pilgrimage tour, or availing any service offered under Bhakti Kawach, every Member confirms that they have read, understood, and voluntarily agreed to abide by these Terms & Conditions.

1. Definitions

1.1 "Trust" means IPV Surakshaa Kawach Charitable Trust.

1.2 "Bhakti Kawach" means the pilgrimage section operated under the Trust.

1.3 "Member" means a person holding a valid Bhakti Kawach Membership.

1.4 "Wallet" means the digital Bhakti Kawach Wallet maintained by the Trust.

1.5 "Tour" means any Bus, Train or Flight pilgrimage organized by the Trust.

2. Membership

2.1 Membership is mandatory for participating in Bhakti Kawach pilgrimage tours.

2.2 Membership is personal, non-transferable and non-assignable.

2.3 Membership cannot be sold, gifted or transferred.

2.4 The Trust reserves the right to verify Member identity at any stage.

2.5 Membership shall remain subject to all rules, policies and amendments issued by the Trust from time to time.

3. Eligibility for Tour Booking

3.1 Bus Tours

A Member may book only one Bus Tour in one calendar month, subject to seat availability and operational policies.

3.2 Train & Flight Tours

A Member shall become eligible to book any Train or Flight pilgrimage only after completion of 120 days from the Membership activation date.

3.3 Cooling Period

After booking any Train or Flight pilgrimage, the Member shall become eligible to book another Train or Flight pilgrimage only after 90 days (3 months) from the previous booking date.

The Trust reserves the right to modify booking eligibility whenever required for operational or administrative reasons.

4. Registration & Verification

4.1 Website Registration is compulsory.

4.2 Every Member shall submit all required documents.

4.3 Government Photo ID may be required.

4.4 Email ID and Mobile Number must remain active.

4.5 Incorrect information may result in rejection or cancellation of Membership or booking.

5. Booking Confirmation

A booking shall be confirmed only after:

• Successful payment.

• Website registration.

• Verification by the Trust.

• Seat availability.

6. Seat Allocation

Seats shall be allotted strictly on First Come – First Served basis.

Seat preferences are not guaranteed.

The Trust may change seats whenever operationally necessary.

7. Tour Schedule

Departure timings shall be strictly followed.

Members must report at least 30 minutes before departure.

Late reporting shall be treated as No Show.

The Trust shall not be responsible for missed departures.

8. Non-Cancellation Policy

STRICT NON-CANCELLATION POLICY

Once a tour booking is confirmed:

• It cannot be cancelled.

• No cash refund shall be provided.

• No bank transfer refund shall be made.

• No UPI refund shall be made.

• No cheque refund shall be made.

• No card refund shall be made.

9. Bhakti Kawach Wallet Credit

If a Member is unable to travel after confirmation or requests cancellation, no cash refund shall be issued.

Instead, the eligible refundable amount, after deduction of applicable administrative, processing, statutory or operational charges (if any), may be credited only to the Bhakti Kawach Wallet, as per the Trust's prevailing policy.

Wallet Balance:

• cannot be withdrawn as cash.

• cannot be transferred.

• cannot be sold.

• cannot be exchanged.

• cannot be redeemed in monetary form.

Wallet credit may only be used for booking future Bhakti Kawach pilgrimage tours.

Wallet validity shall remain subject to Trust policy.

10. Cancellation by the Trust

The Trust may postpone, modify or cancel any tour due to:

• Natural disasters

• Flood

• Heavy rainfall

• Landslide

• Earthquake

• Pandemic

• Epidemic

• Government Orders

• Court Orders

• Law & Order Situation

• Political Disturbance

• Airline cancellation

• Railway cancellation

• Bus operator issues

• Technical issues

• Low participation

• Force Majeure

• Any circumstance beyond Trust control

In such cases the Trust may:

• Reschedule the tour, or

• Credit the amount to the Bhakti Kawach Wallet.

No compensation shall be payable.

11. Member Responsibilities

Every Member shall:

• Carry valid Government ID.

• Maintain discipline.

• Respect religious places.

• Follow Tour Coordinator instructions.

• Follow local laws.

• Respect fellow pilgrims.

• Protect Trust property.

12. Health & Medical Responsibility

Members shall ensure that they are medically fit.

The Trust shall not be responsible for:

• Illness

• Medical emergencies

• Accidents

• Pre-existing diseases

• Pregnancy-related issues

• Death due to natural causes

Members travel entirely at their own risk.

13. Luggage

Members are solely responsible for their luggage.

The Trust shall not be liable for:

• Theft

• Loss

• Damage

• Delay

14. Hotels, Airlines & Transport

Hotels, Airlines, Railways and Bus Operators are independent service providers.

The Trust acts only as a facilitator.

The Trust shall not be liable for deficiencies attributable to third-party service providers.

15. Temple Rules

Temple Darshan timings, Temple Registration, VIP Darshan, Entry Rules and Temple Administration shall remain solely under the control of the respective Temple Authorities.

The Trust has no control over Temple Management.

16. Meals

Only meals specifically mentioned in the itinerary shall be included.

Any additional food, beverages or personal requirements shall be borne by the Member.

17. Itinerary Changes

The itinerary may change without prior notice due to:

• Weather

• Traffic

• Temple timings

• Government restrictions

• Operational reasons

18. Force Majeure

The Trust shall not be liable for failure or delay caused by events beyond its reasonable control.

19. Misconduct

The Trust reserves the right to remove any Member from the tour without refund if they:

• Consume alcohol

• Consume drugs

• Smoke in prohibited areas

• Misbehave

• Damage property

• Violate law

• Disturb other pilgrims

20. Photography & Media Consent

The Trust may photograph or record Members during tours.

Members grant irrevocable permission to use such photographs or videos for promotional, educational or informational purposes without payment or prior approval.

21. Limitation of Liability

The Trust's total liability, if any, shall never exceed the actual amount paid by the Member for the concerned tour.

The Trust shall not be liable for:

• Indirect loss

• Consequential damages

• Mental stress

• Loss of opportunity

• Business loss

• Personal inconvenience

22. Indemnity

The Member agrees to indemnify and hold harmless:

• IPV Surakshaa Kawach Charitable Trust

• Bhakti Kawach

• Trustees

• Employees

• Volunteers

• Coordinators

• Representatives

against all claims, liabilities, damages, legal expenses and proceedings arising from the Member's own acts, negligence or breach of these Terms.

23. Amendments

The Trust reserves the absolute right to amend, modify, replace or update these Terms & Conditions at any time without prior notice.

The latest published version shall prevail.

24. Governing Law & Exclusive Jurisdiction

These Terms & Conditions shall be governed by the laws of India.

Any dispute, claim, complaint, legal proceeding, recovery proceeding, arbitration-related proceeding (where applicable), interpretation, enforcement, or matter arising out of or in connection with the affairs, activities, management, agreements, Membership, services, or operations of IPV Surakshaa Kawach Charitable Trust, including Bhakti Kawach, shall be subject to the exclusive territorial jurisdiction of the competent Courts at New Delhi, in accordance with applicable law.

Wherever applicable under law, matters falling within the pecuniary or subject-matter jurisdiction of the Hon'ble High Court of Delhi shall be instituted before the Hon'ble High Court of Delhi. No proceedings shall be instituted before any other court except where required by applicable law.

The Member expressly agrees to submit to the jurisdiction of the competent Courts at New Delhi and waives any objection regarding territorial jurisdiction, venue or forum, to the maximum extent permitted by law.

25. Binding Acceptance

By obtaining Membership, registering on the website, making any payment, booking any pilgrimage tour or using any service of Bhakti Kawach, the Member irrevocably confirms that:

• These Terms & Conditions have been read carefully.

• They are fully understood.

• They are voluntarily accepted.

• They constitute a legally binding agreement between the Member and IPV Surakshaa Kawach Charitable Trust.

• Electronic acceptance through the website shall have the same legal effect as a physical signature, to the extent recognised under applicable law.

26. Final Decision

The interpretation, implementation and administration of these Terms & Conditions shall be carried out by IPV Surakshaa Kawach Charitable Trust.

Subject to applicable law, the decision of the Trust on matters relating to Membership, bookings, wallet credits, operational policies and tour management shall be final and binding on all Members.

 

DISCLAIMER, ASSUMPTION OF RISK & LIMITATION OF LIABILITY

1. Voluntary Participation:
   Every participant joins the religious tour voluntarily and at their own discretion after understanding the nature of the journey.
2. Personal Responsibility:
   Each participant shall be solely responsible for their own personal safety, health, conduct, luggage, valuables, money, mobile phone, identity documents, medicines, and other personal belongings throughout the tour.
3. Health and Fitness:
   Every participant confirms that they are medically fit to undertake the journey. Participants with any medical condition shall carry their prescribed medicines and inform the organisers in advance wherever necessary.
4. Limited Role of the Trust:
   IPV Surakshaa Kawach Trust acts only as a facilitator and organiser for the religious tour by arranging basic travel-related facilities at affordable and subsidized rates for the convenience of devotees. The Trust is not a tour operator providing insurance or guaranteeing the safety of participants.
5. No Liability for Unforeseen Events:
   The Trust, its Trustees, office bearers, volunteers, employees, or representatives shall not be held liable for any loss, theft, damage, accident, injury, illness, disability, death, delay, cancellation, natural calamities, adverse weather conditions, road accidents, acts of third parties, government restrictions, or any other unforeseen event beyond the reasonable control of the Trust.
6. Compliance with Instructions:
   Every participant shall follow the instructions issued by the organisers, local authorities, transport operators, and temple administration. Any participant acting against such instructions shall be solely responsible for the consequences of their actions.
7. Personal Insurance:
   Participants are advised to obtain their own travel and medical insurance before undertaking the journey.
8. Indemnity:
   Each participant agrees to indemnify and keep indemnified IPV Suraksha Kavach Trust, its Trustees, office bearers, volunteers, employees, and representatives against any claims, liabilities, damages, losses, costs, or expenses arising out of the participant's own acts, omissions, negligence, breach of instructions, or violation of law.
9. Declaration:
   By registering for and participating in the tour, every participant confirms that they have read, understood, and voluntarily accepted the terms and conditions contained in this disclaimer and agree to abide by them.
